Rules for holding “Guess & Win” quiz

The current regulation document clarifies the principle of conducting the “Guess & Win” Quiz by means of voice calls, as well as determining the procedure for conducting this competition and the rules for participation.

Article 1 – GENERAL CONDITIONS

1.1 The period of the “Guess & Win” IVR Quiz (hereinafter – the Quiz) is one calendar month, with the possibility of automatic extension. Start date of the Quiz 17/11/2022
1.2 The quiz is held exclusively for subscribers of the Mobile Operator Econet Zimbabwe.
1.3 Quiz is an additional communication service of an entertainment nature, which allows subscribers, by dialing the service numbers 403 and 765, to check their erudition, identifying the performers of musical compositions.
1.4 The Quiz is not a lottery, an incentive lottery or any other risk-based gambling game, since the prize pool of the Quiz is not randomized.
1.5 Participation in the Quiz is carried out by making voice calls by subscribers of the Operator from a mobile phone.
1.6 Short numbers for making calls within the quiz – 403 and 765
– The cost of one minute of a call to the short number 403 is 0.00 ZIG for all mobile subscribers of Econet Zimbabwe
– The cost of one minute of a call to the short number 765 is 0.52 ZIG (including VAT) for all cellular subscribers of Econet Zimbabwe
1.7 The fact of registration for participation in the Quiz confirms that the participant has properly read, understood and agrees with all the terms of these Regulations.
1.8 For the first 24 hours during the Try & Buy period, subscribers can participate in the Quiz without any time limits. After the automatic transition to paid subscription and within the subscription cost, the total duration of calls per day by each participant is limited by a daily limit.
• For short number 403 – 120 minutes / day;
• There is no limit for the short number 765.

Article 2 – REGULATIONS DEFINITIONS

2.1. Provider – a company conducting the Quiz on the basis of the relevant agreements with the Operator.
2.2. Quiz – a game based only on the intellectual abilities of the participants, without any hints or additional information, conducted through voice calls, in which Operator’s subscribers are able to answer various questions of the Quiz, collect points and claim the prizes of the Quiz.
2.3. Quiz Participant – a capable individual who has reached the age of 18 (eighteen) years, who is a resident of the Republic of Zimbabwe, a subscriber of the Operator, who has expressed a desire to participate in the Quiz. Participation in the Quiz is carried out through outgoing calls to the Quiz numbers 403 and 765.
2.4. Quiz Call – any phone call made by a subscriber in the Operator’s network of Econet Zimbabwe to short numbers 403 and 765.
2.5. Subscription to the service – Access to participate in the Quiz with a daily payment of 1.10 ZIG or 0.03 USD, including VAT. At the first connection, a free period of participation in the Quiz is provided – 24 hours. After the free period expires, the paid period starts automatically.

2.6. Points – virtual units that will be added to the virtual account of the subscriber identified by the GSM phone number. The only indicator of this virtual account is the GSM phone number from which voice calls will be made to the short number 403 and 765 during the Quiz.
2.7. Quiz question – a question that requires the choice of one of the answer options provided for the subscriber’s review, when calling the short number 403 and 765 during the Round.
2.8. The answer of the Quiz – answer to the Quiz question, selected by subscriber, when calling short number 403 and 765. One of the answer options which is offered to the Subscriber is registered as correct. When a customer chooses any of the proposed answers during the Round, he will be informed whether the choice is right or wrong.
2.9. The winner of the Round – the Participant who is acting in exact accordance and consistency with the conditions established in these Regulations, and who scores the highest number of points within 30 days of the Round.
2.10. Calendar period – a Period consisting of 30 calendar days.
2.11. Daily limit – a time Limit of 120 minutes, set by the Provider for the total daily participation in the Quiz for subscribers with a paid subscription. During the Try & Buy period, participation in the Quiz is unlimited:
• Short number 403 – 120 minutes/ day;
• Short number 765 – no restrictions.

Article 3 – THE QUIZ CONDUCTION

3.1. To participate in the Quiz, Customer must have an active subscription to the “Guess & Win” Quiz.
3.1.1. Subscription activation can be carried out, when:
– Calling short number 403 and following the voice menu instructions;
– Dialing short code *403# and following the menu instructions;
3.2. The cost of subscription to the Quiz service, including VAT, is  1.10 ZIG per day or 0.03 USD per day. In case of unsuccessful charging attempts during 60 calendar days, the subscription to the Quiz service is automatically deactivated, and all the points of the participant are automatically reset.
3.3. Subscription deactivation and participation refusal can be carried out, when:
– Calling service number 403 and selecting “Manage Subscription” in the voice menu;
– Sending an SMS with the text “STOP” to the short number 403;
3.4. After service activation, the Participant receives an SMS notification that subscription was activated.
3.5. Subscriber activates the subscription by calling the Quiz number of Standard tour – 403, the subscriber listens to fragments of melodies. The goal of the subscriber is to specify the artist by pressing a certain key on the phone with the correct answer.
The cost of a call to short Quiz number 403 – 0,00 ZIG.
• Points calculation:
• For each correct answer the Subscriber gets – 5 points,
• The scoring algorithm is the same for all Participants.
3.6. After subscribing to the service, the subscriber can listen to fragments of melodies by calling 765, the number of the Bonus tour. The goal of the subscriber is to specify the artist by pressing a certain key on the phone with the correct answer.
• The value of the call made to 765 – 0.52 ZIG / min;
• For each correct answer the Subscriber gets – 50 points;
• The points calculation algorithm is the same for all participants;
• The limit for the calls to the short number 765 is unlimited.
3.7. After service deactivation, the Participant receives an SMS notification that subscription is deactivated and all the earned points are lost.
3.8. At the end of each 30-day Round, the points of all subscribers are reset.

Article 4 – WINNER SELECTION AND PRIZE DELIVERY

4.1. When determining the winners of the Quiz, objective data about the number of points scored by participants, which is stored on the Provider’s platform, is used. The principle of randomly determining the winners in the Quiz is not used.
4.2. The Winners of the Quiz are the Participants who scored the highest number of points during the Quiz for a certain period of time and who, at the time of scoring and identifying the winner, have an active subscription to the Quiz service. If several subscribers have scored the same number of points, the Winner is the subscriber who has scored points in less time (the time spent from the first response of the subscriber to the last one is taken into consideration).
4.3. The Winners of the Month of the “Guess & Win” Quiz are determined based on the results of each last calendar day of the month from the date of the Quiz launch as of 23:59:59.
The Winners are the 3 Participants who scored the highest number of points based on the results of the calendar period and who, at the time the points were calculated, had an active subscription to the “Guess & Win” Quiz service on the day the Winner was determined at 23:59:59.

There are 3 winners of the month :

1. 1st place winner of the month receives a prize – 500$
2. 2nd place winner of the month receives a prize – 250$
3. 3rd place winner of the month receives a prize – 100$

*Note, that prize amount will be transferred to the bank account of the winner.

4.4. One and the same Subscriber can’t become the winner of the Month within the framework of 6 months.
During the period of the Quiz, the Participant can be recognized as the Winner of the Quiz and win:
• Monthly prize – no more than 1 time within 6 months.
4.5. The prize of the month is awarded within 30 calendar days following the calendar month in which the prize took place. The presentation is carried out on condition that the Winner submits an identity card and confirms the fact that the winner of the drawing has a GSM phone number that participated in the Quiz, presents the SMS Notification informing about the winner of the month. The prize is awarded in one of the Econet offices. The date, time and address of the office where the prize will be awarded are preliminarily agreed with the winner. The prize is not delivered to the territory of foreign countries.
4.6. Data on the winners of the Month is published on the winner’s page of the “Guess & Win” quiz website.
4.7. To receive the prize, the winner must provide the following information:
• National ID
• Full Name and Surname
• Date of Birth
• Bank account details for transfer
• SMS-Notification informing that he/she has become the winner of the month
a) If the winner is unable to provide the information above, the prize will be cancelled and the next ranked participant will be considered as a Winner.
b) If the winner has no bank account, he/she would be suggested to open it. If the winner would not agree to open bank account, then the next ranked participant will be considered as a Winner with the condition that he/she has bank account or agrees to open it.
4.8. If the winner provides all of the above information and is legally verified, the Econet Zimbabwean team makes the transfer to winner’s bank account in local currency according to the average exchange rate of the billing month.

Article 5 – RESTRICTIONS

5.1. Employees and representatives of the Provider, Operator and companies that provide technical assistance in conducting the Quiz, as well as family members of such employees and representatives of companies, cannot participate in the Quiz.
5.2. Within participation in the Quiz, Subscribers are prohibited from using:
– Any equipment other than the subscriber device with the Econet SIM-card, that being a mobile phone (hereinafter – “Mobile phone”);
– Any software, including that which is installed on the Mobile phone, except software which is developed by the Provider;
– Software developed by the Provider and designed for participation in the Quiz, modified in any way, including through program code intervention;
– Any other ways and means of automating the process of participation in the Quiz, which are determined according to the technical system used by the Provider to document the Quiz (logs). The data of the technical system shall be deemed final and shall not be challenged by the Participant. Signs of automation of participation in the Quiz are identified by patterns in the frequency of responses, sending a response to a question in less than 5 (five) seconds and other signs.
5.3. Participants who do not meet the above requirements are not eligible to participate in the Quiz and are not able to receive prizes.

Article 6 – OPERATOR LIABILITY LIMITATION

6.1. The mobile operator is not the organizer of the Quiz and is not responsible for the actions of the Provider, as well as for any consequences of these actions, directly or indirectly relating to third parties.
6.2. By calling the short number 403, the Participant authorizes the Operator and confirms its consent to the provision by the Operator of the Participant’s personal information to the Provider, namely: the phone number from which the call was made, as well as the date and time of the call.
6.3. Participation in the Quiz is a voluntary action of the subscriber. The Participant takes responsibility for any consequences of his/her participation in the Quiz.
6.4. The Operator does not provide any information regarding the Quiz. All questions and claims in connection with the Quiz are sent to the Provider by the contact information specified in this Regulation.
6.5. The Operator provides the opportunity to make voice Calls only within the coverage area of the Operator’s network.
6.6. By participating in the Quiz, the Participant confirms acceptance of the terms of limitation of the Operator’s liability.
